Responsible Use Policy (RUP)

Effective Date: April 10, 2025

Purpose

United States Telecommunications Corporation (“USTelco”) is committed to providing secure, reliable, and high-quality communication services. This Responsible Use Policy (RUP) outlines the standards of conduct expected from all users of USTelco services. It is designed to complement our Acceptable Use Policy (AUP) by detailing responsible and lawful usage practices in plain language. By establishing clear guidelines, we aim to protect our users, our network, and the broader community from misuse of telecommunications services. Your cooperation in following these rules helps ensure a safe and trustworthy network for everyone.

Scope

This Policy applies to all users of USTelco services, including individual consumers, business customers, their end-users, and any person or entity utilizing USTelco’s networks, platforms, or equipment. It covers all USTelco offerings – voice calls, messaging (SMS/MMS), internet and data services, and any other telecommunications or digital services provided by USTelco. Each user is responsible for ensuring that anyone they permit to use USTelco services (e.g. employees or customers) also adheres to this Policy.

By using or continuing to use USTelco services, you acknowledge that you have read, understood, and agree to abide by this RUP (in addition to our AUP and other applicable terms). If you do not agree to these terms, you must discontinue use of USTelco services. Using USTelco services signifies your consent to this Policy.

Core Principles

USTelco’s Responsible Use Policy is grounded in a few core principles that guide all acceptable conduct on our network:

  • Lawful and Ethical Conduct: Users must comply with all applicable laws and regulations. This includes telecommunications laws and directives from agencies like the Federal Communications Commission (FCC) and Federal Trade Commission (FTC). USTelco and its users will adhere to industry standards and federal laws (such as the Telephone Consumer Protection Act, the TRACED Act, and STIR/SHAKEN caller ID authentication frameworks) to combat illegal spam, fraud, and abuse. All activities on our network should be legal, honest, and in good faith.
  • Respect for Others: Users should behave courteously and respect the rights and dignity of others. Responsible use means not using USTelco services to harass, threaten, or harm anyone. We expect professionalism and civility in all communications. Any form of discrimination, hate, or exploitation using our services is against our values and this Policy.
  • Privacy and Security: USTelco is committed to protecting privacy and maintaining robust security. Users must respect the privacy of others’ information and communications and are expected to safeguard their own accounts and devices. Do not attempt to bypass security measures. Responsible use includes keeping your credentials confidential and promptly reporting suspected security breaches or abuses.
  • Network Integrity: Users share responsibility for the health of our network. Any use that could damage, disrupt, or degrade USTelco’s networks or services is prohibited. This principle ensures that all customers enjoy reliable service quality. Users should avoid excessive or abnormal usage patterns that imperil network performance or deny others fair access, and must not introduce malicious software or unlawful devices onto the network.
  • Accountability: All users are accountable for their actions on USTelco’s platform. If you misuse the service, you may face consequences under this Policy. Likewise, USTelco holds itself accountable to enforce these rules fairly. We strive for transparency in how we enforce policies and will provide explanations for decisions when possible.

These core principles underpin the specific rules outlined below. They serve as a foundation for understanding what USTelco considers responsible (and irresponsible) use of its services.

Acceptable Use

Acceptable Use” of USTelco services means using them in a legal, ethical, and intended manner consistent with the service’s purpose and USTelco’s core principles. While it’s impossible to detail every acceptable activity, the following guidelines illustrate the spirit of acceptable use:

  • Lawful Purposes: Use USTelco services only for lawful activities. This includes personal or business communications, accessing information, and other legitimate endeavors that do not violate any law or regulation. For example, making personal or business telephone calls, sending emails and texts to willing recipients, browsing the internet, and streaming content you have rights to are all acceptable uses.
  • Personal and Commercial Communication: You may use our network to freely communicate and exchange information for personal, educational, or commercial purposes, as long as such use is respectful and compliant with this Policy. Legitimate uses include everyday voice calls, text or multimedia messaging, video conferencing, and business outreach like customer service calls or opt-in marketing (provided proper consent has been obtained).
  • Respectful Engagement: When using USTelco services, treat others with respect and follow normal standards of civility. You should refrain from profanity or abusive language, and honor other users’ preferences and requests (for instance, if someone asks to stop receiving communications from you, you should respect their request). Healthy debate and free expression are acceptable, but not hate speech or harassment.
  • Protecting Network Health: Use USTelco’s network in a way that does not interfere with other users’ service. For example, use bandwidth-intensive applications considerately and adhere to any service-specific usage limits or guidelines provided by USTelco. Ensure that any devices or equipment you connect to our network are secured and free of viruses or malware, so they do not inadvertently harm the network or other users.
  • Compliance and Cooperation: Follow any rules, guidelines, or requests issued by USTelco regarding the use of services. For instance, if USTelco implements call authentication or spam mitigation measures (like STIR/SHAKEN caller ID verification), cooperate with these measures – they are in place to protect everyone. If USTelco contacts you regarding a potential issue (e.g. a security concern or misuse report), respond promptly and take any corrective action needed.

Acceptable use essentially boils down to using our services in a way that is legal, responsible, and considerate. If you are ever unsure whether something is permitted, err on the side of caution and consult USTelco or refer to this Policy and the AUP for guidance.

Prohibited Conduct

To maintain a safe and reliable service, USTelco strictly prohibits the following types of conduct. Engaging in any of these activities, or assisting others in doing so, violates the RUP and may lead to enforcement actions (see Enforcement below). This list is comprehensive but not exhaustive; similar activities that violate the spirit of this Policy are also prohibited:

  • Illegal or Unlawful Use: Using USTelco services to conduct or facilitate any activity that violates the law or regulations. This includes, but is not limited to, activities that violate federal, state, or local laws or rules (for example, laws against fraud, theft, stalking, or illicit trade). All Users must adhere to communications laws such as the Telephone Consumer Protection Act (TCPA) and the TRACED Act. Any use of our network for criminal purposes or to further illegal schemes is strictly forbidden.
  • Unsolicited Bulk Communications (Spam): Spamming is prohibited. You may not use USTelco services to send unsolicited bulk messages, whether via phone calls, text/SMS, email, or fax, especially for commercial purposes. This includes mass robocalls, auto-dialed or pre-recorded telemarketing calls, and unsolicited texts sent without proper consent or in violation of do-not-call or anti-spam laws. All telemarketing or commercial messaging must comply with applicable consent requirements, FCC/FTC regulations, and the CAN-SPAM Act (for emails) where relevant. If a recipient has opted out or asked you to stop contacting them, you must honor that request promptly.
  • Fraud and Deception: You may not use our services to engage in fraudulent, deceptive, or misleading practices. This includes impersonating any person or entity, phishing (attempting to acquire sensitive information under false pretenses), scams or pyramid schemes, false advertising, or any communication intended to defraud, extort, or mislead others for personal gain. Users are forbidden from misrepresenting their identity or affiliation in a way that is intended to deceive recipients. For example, you must not pretend to be a bank or government agency if you are not, and you must not attempt to trick people into providing passwords, financial information, or other private data.
  • Caller ID Spoofing and Misuse of Identification: Manipulating or falsifying caller identification or message headers to deceive or mislead is strictly prohibited, except where expressly allowed by law. USTelco complies with STIR/SHAKEN protocols to verify caller ID authenticity; users must not attempt to evade these measures. You may not transmit a call, text, or email that deliberately disguises or alters the originator’s identity (such as “spoofing” a phone number or email address) in order to impersonate someone else, commit fraud, or wrongfully hide your identity. Legitimate use of alternate caller ID (for example, a business using its main line as the outbound caller ID for employees) must comply with the law and have proper authorization. Any unauthorized or malicious caller ID spoofing – for instance, to impersonate emergency services, law enforcement, or private individuals – is a serious violation.
  • Harassing or Offensive Communications: USTelco services must not be used to harass, abuse, or harm others. Prohibited behaviors include sending threats, repeated unwanted calls or messages to a specific person (stalking or intimidation), and using obscene or profane language with the intent to offend or alarm. Additionally, users may not use our network to distribute content that is defamatory, obscene, pornographic, or highly offensive. Hate speech – any communication that promotes violence or prejudice against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other such characteristics – is strictly forbidden on our services. While USTelco is not responsible for the content of user communications, we reserve the right to intervene if we become aware of extreme abuse or harassment occurring over our network.
  • Intellectual Property and Privacy Violations: Users must respect intellectual property rights and privacy rights at all times. Do not use USTelco services to transmit, distribute, or store any content that infringes copyrights, trademarks, patents, trade secrets, or other proprietary rights of others. For example, you may not use our internet services to share pirated software, music, movies, or other copyrighted materials without permission. Likewise, you may not violate others’ privacy by disclosing personal or confidential information without authorization. Prohibited conduct includes: sharing someone’s private data (such as phone number, address, Social Security number, account credentials, or personal photos) without their consent, or using our services to spy on or collect information about individuals in an illicit manner. USTelco respects privacy laws (including FCC rules on Customer Proprietary Network Information) and expects users to do the same.
  • Security Attacks and Network Intrusions: Any attempt to undermine the security or integrity of networks or systems is forbidden. You may not use USTelco services to distribute viruses, worms, malware, or any other harmful code. You may not launch or facilitate cyber-attacks such as denial-of-service (DoS or DDoS) attacks, nor attempt to hack or gain unauthorized access to any account, computer, data, or network (whether USTelco’s, another user’s, or any third party’s). Probing or scanning the vulnerability of systems, or breaching security measures without permission, is a violation of this Policy. Additionally, using our network to conduct or forward phishing attacks or to operate botnets is strictly prohibited. We expect users to practice good cybersecurity hygiene – if you become aware that your device or account is infected or compromised, you should take immediate action to fix it and notify USTelco if relevant.
  • Network Abuse and Service Interference: You may not engage in activities that interfere with or disrupt the normal use of USTelco’s network by other customers. This includes any usage that causes technical harm or degrades service performance for others. Examples of network abuse include: generating unusually high volumes of traffic that could congest the network (outside of what is normal for your subscribed service plan), running unauthorised servers or services in a manner that violates your service terms, or using automated dialing or messaging programs that overwhelm network capacity. It is also prohibited to attempt to bypass or impair any network security or filtering mechanisms USTelco has in place (for instance, attempting to thwart spam filters or call authentication systems). You must not use USTelco services in any way that disrupts other users’ ability to smoothly access and enjoy our services. We reserve the right to manage network traffic and ensure quality of service, which may include blocking or limiting improperly high traffic from abusive activities.
  • Unauthorized Resale or Transfer of Service: USTelco services are intended for the use of the account holder and any authorized users under that account. Reselling, sharing, or providing access to USTelco services to third parties without our express permission is prohibited. This means you should not attempt to act as a service provider or telecom carrier using our services (for example, by re-routing calls or data through your account to others for a fee) unless you have a specific written agreement with USTelco allowing it. Similarly, you may not assign or transfer your service to someone else unless permitted by our Terms. Any commercial exploitation of USTelco services outside the scope of your agreement with us is not allowed. If you are a wholesale or enterprise partner with a contract that allows certain re-use of our services, you must still ensure all end users abide by this RUP and the AUP.

Please note: The above categories are guidelines. Other forms of harmful misuse not specifically listed may still violate this Policy. If you are unsure whether an action might be prohibited, please contact USTelco for clarification before proceeding. All users are expected to use common sense and good judgment to avoid any activities that could be deemed irresponsible or abusive.

Enforcement

USTelco takes violations of this Responsible Use Policy seriously. We monitor for compliance and will respond to violations in order to protect our network and customers. Violations may result in temporary or permanent actions against the offending user or account. USTelco reserves the right, at our sole discretion, to take any of the following enforcement steps (or other appropriate measures) if we believe a user has violated this Policy or any related terms:

  • Investigation: USTelco may monitor usage and investigate any suspected breach of the RUP or AUP. While USTelco generally does not monitor the content of communications without cause, we reserve the right to investigate (which may include reviewing network logs, metadata, and other relevant information) if we detect unusual activity or receive complaints. Your privacy is important to us, and any monitoring or investigation will be conducted in accordance with applicable privacy laws and our Privacy Policy.
  • Warnings and Notifications: For less severe issues or first-time violations, USTelco may issue a warning or notice to the user. We might contact you (via email, phone, or other method) to explain the problematic conduct and ask that you rectify it or cease the offending activity. You are expected to comply promptly with any such warning.
  • Service Suspension or Restriction: USTelco may suspend or limit your access to certain services if you violate this Policy. Suspension can be partial (for example, blocking the ability to send international SMS if that is where abuse occurred) or full (temporary disconnection of service). We strive to tailor enforcement to be as limited as possible while addressing the issue. For instance, if your broadband usage is causing network issues, we may temporarily throttle your connection until the matter is resolved. In urgent cases (such as ongoing security attacks or fraud), we may suspend service immediately and without prior notice to prevent further harm.
  • Service Termination: In the case of serious or repeat violations, USTelco may terminate your service or account altogether. Termination means a permanent disconnection of all USTelco services for the user or account in question. We prefer to avoid this outcome and will usually attempt other remedies first, but we will not hesitate to terminate services for egregious abuses (for example, running an illegal robocall operation, persistent harassment of others, or any activity that poses significant legal risk to USTelco or others). If your account is terminated for RUP violations, you may be barred from reopening an account or using USTelco services in the future.
  • Filtering and Blocking of Content/Traffic: USTelco reserves the right to block or filter any communications or traffic on our network that we reasonably believe violates this Policy or applicable law. This can include blocking spam calls or messages, filtering emails flagged as phishing, or using robo-call mitigation systems to drop obviously illegal calls. We implement industry-standard measures (such as STIR/SHAKEN call authentication and spam filtering technologies) to protect customers; in doing so, some abusive or suspicious traffic may be intercepted or prevented from reaching its destination. By using our service, you understand and consent that your communications may be subject to such filtering or blocking when necessary for enforcement and network protection.
  • Legal Action and Reporting: Where a violation of this Policy also constitutes a violation of law (or in extreme cases even if not explicitly illegal), USTelco may refer the matter to law enforcement or regulatory authorities. We will cooperate with the appropriate agencies (such as the FCC, FTC, or police) in any investigation or prosecution of illegal acts involving our services. In addition, USTelco reserves the right to pursue civil legal action against users to enforce this Policy or seek remedies for harm done to our business or network. This can include seeking injunctions to halt prohibited conduct or suing for damages, costs, and attorneys’ fees incurred due to the violation.
  • Administrative Fees or Recovery of Costs: To the extent permitted by law and your service agreement, USTelco may charge administrative fees or recover costs associated with a user’s violation of the RUP. For example, if a user’s actions cause us to incur costs (such as investigation expenses, network repair costs, or fines from regulators), we may seek reimbursement from that user. Additionally, if service is suspended or terminated due to misuse, reactivation (if allowed) might be conditioned on payment of reactivation fees or assurances of compliance.

USTelco will endeavor to notify users of enforcement actions being taken, though in cases of urgent threat or unlawful activity, we may act immediately and notify afterward. All enforcement measures are applied at USTelco’s discretion and may be cumulative – exercising one remedy (like a suspension) does not preclude further action (like termination or legal action) if warranted.

Nothing in this Policy limits our right to act as needed to protect our network, comply with the law, or ensure the well-being of our customers and third parties. USTelco shall not be liable for any damages resulting from the good faith exercise of our rights under this Enforcement section (for example, disconnecting a service in line with these terms). Failure by USTelco to enforce any part of this Policy in one instance does not waive our right to enforce it in another instance. Users are expected to continuously comply with the RUP, and USTelco’s choice not to act immediately on a violation does not mean we approve of the behavior or that the rule is no longer in effect.

Reporting Violations

USTelco relies on our user community and others to report potential violations of this Responsible Use Policy. If you become aware of any misuse of USTelco services or suspect a violation of this Policy, we urge you to report it immediately. Timely reporting helps us address problems quickly and prevent further harm.

To report a violation or express a concern, you can contact USTelco through any of the following channels:

  • Email: Send a detailed report to [email protected] (our dedicated abuse reporting address). Please include as much information as possible, such as the phone numbers, email addresses, dates/times of incidents, and a description of the offending conduct or content. Screenshots, call records, or message transcripts (if available) can help us investigate.
  • Phone: Call USTelco Customer Support at 1-800-596-5036 or dial 611 from your USTelco mobile phone. Inform the representative that you wish to report a RUP violation or abusive activity. They will guide you through the process and gather necessary details.
  • Online Form: Visit our official website and use the Abuse/Compliance Reporting Form (located on the Support or Contact Us page). Fill in the requested details about the issue and submit the form. This will automatically log a case with our compliance team for review.
  • Mail: (If needed) You may send written correspondence with details of the issue to USTelco’s corporate address, Attn: Abuse Compliance. However, email or phone reporting is much faster and strongly preferred for prompt action.

All reports will be reviewed by USTelco’s security and compliance team. We may reach out to you for additional information if necessary. We treat reports confidentially and will not retaliate against anyone for reporting in good faith. If you are a victim of harassment or other abuse, we will take steps to ensure your report is handled sensitively and, if appropriate, that your identity is protected.

In addition to reporting to USTelco, if the issue involves unlawful content or threats to personal safety, you may wish to report it to law enforcement. USTelco can assist law enforcement investigations as needed once an official request is received.

By working together and reporting problems, users help USTelco maintain a community where everyone can communicate safely and responsibly.

Updates and Revisions

Telecommunications technology and legal requirements are continually evolving. USTelco will update this Responsible Use Policy as necessary to adapt to new challenges, services, or regulations. We reserve the right to modify or amend the RUP at any time. However, we are committed to transparency and will inform users of significant changes:

  • Notification of Changes: When we make material updates to this Policy, USTelco will notify users by posting the revised Policy on our website with a new “Effective Date” (and, where required or appropriate, by additional means such as email or customer portal notifications). We encourage you to periodically review the RUP (and AUP) on our website to stay informed of any changes. A history of changes or a “Last Updated” note may be provided for reference.
  • Effective Date: The effective date at the top of this Policy indicates when the current version came into force. April 10, 2025 is the effective date of this version of the RUP. Any revisions will typically include a new effective date.
  • Continued Use = Acceptance: By continuing to use USTelco services after a revision takes effect, you are affirming your acceptance of the updated terms. If you do not agree with a change, you must stop using the services and may terminate your agreement (subject to any contractual obligations). We value our users and strive not to make sudden, unfair changes, but ultimately it is your responsibility to review and abide by the current Policy.
  • Relation to Other Policies: This RUP is a supplement to our Acceptable Use Policy and does not replace any other terms of service, customer agreements, or privacy policies that apply to your use of USTelco services. In the event of a conflict between this RUP and another USTelco policy or contract, USTelco will interpret the provisions in a consistent manner to the extent possible; otherwise the more specific term (or legally required term) will take precedence. We may also update the AUP or other policies from time to time, in which case we will provide notice per those documents.

Governing Law & Jurisdiction

This Responsible Use Policy is governed by and shall be construed in accordance with the laws of the State of Delaware, together with applicable federal law of the United States. By using USTelco services, you agree that any legal action or proceeding arising out of or relating to this Policy (or your use of the services) shall be brought exclusively in the courts of the State of Delaware. This means that if you ever have a dispute with USTelco regarding this Policy, you will file your claim in a court located in Delaware (state or federal, as appropriate). You further consent to the personal jurisdiction of those Delaware courts for resolving any such dispute, and waive any objections to venue on the grounds of inconvenience or otherwise.

In choosing Delaware law as the governing law, USTelco does not waive any legal protections or obligations imposed by federal telecommunications law or other state laws that may apply independently. Rather, this clause establishes which jurisdiction’s law will control the interpretation of this Policy and where disputes will be handled, to provide consistency and predictability.

Please note that USTelco’s services may be subject to tariffs, FCC regulations, and other legal requirements that have their own jurisdictional or dispute resolution rules. This Policy is intended to complement and operate alongside those requirements, not override them. If any provision of this RUP is found to be illegal or unenforceable under Delaware law (or applicable federal law), the remaining provisions will remain in full force and effect.

By adhering to this Responsible Use Policy, all users help maintain the integrity, security, and reliability of USTelco’s services. We appreciate your commitment to these standards. Continued use of USTelco services indicates your acceptance of this Policy and your agreement to use our network responsibly and lawfully.
